Cd-wow and Play.com to face legal action!

Not DVD related I know, but cd retailers CD-wow and Play.com are being sued - see here for the full story.

Ah well, if they want to go ahead and do that, then people like me will turn to the wonders of broadband and download the stuff for free...talk about shooting themselves in the foot...now they won`t get any revenue! :D

I already download most of my albums, but as a `Try Before I Buy` scheme. Suppose it`s good publicity for online retailers and it may result in lower priced cd`s across the board.
On the otherhand it could just lead to play and Cd-wow relocating their base of operations outside the UK - even more British jobs being outsourced!

OK. I`m sick of all this poncing about by organisations like the BPI. >:( >:(

I may be only one person, but I can make a difference.

I will never buy another UK CD. I`ll buy from CD-Wow or whoever is cheapest off the `net.

If I can`t get what I want, then I`ll go without.

The UK market for CD`s have now lost one customer, for good and it`s the fault of the BPI.

Should just drop the law.

Then everything will be fine. High street retailers can buy from these cheaper wholesalers surely?

If the overall price of Cds drops, there will be less piracy and it will be good for the music industry as a whole, as many more CDs will be bought.

I thought Play were based in Jersey.
Considering that Jersey is not a member of the E.U. and only has an agreement with the E.U. for certain trade I would think that Play would be able to put up a reasonable defense against the "Source from within the E.U." restrictive practices employed by the E.U.

As others have posted , if they shut Play CD-WOW or others down then the punters will simply use American or Australian sites thereby reducing the profits of the European based retailers .

Both Play (Jersey) and CD WOW (Hong Kong) operate from outside the EU.

This is not about sourcing from the `grey market` (as with Tescos & Levis etc) but about parallel importing.

Basically the copyright owners of the music have allowed disc A to be sold in Asia and disc B to be sold in Europe. What is happening with these retailers is they are selling Disc A in Europe, for less than Disc B is sold for. That is a breach of copyright, hence it is illegal. Of course the stupid thing is that unlike downloading, it does not defraud the writers etc. All that it essentially does is stop the big publishing boys from price-fixing, and ripping off us Brits. Unfortnately, the BPI represent the big boys. . . . . . lets hope we get a sensible judge.

Ironically, the BPI are saying how great the uk market is at the moment, with highest album sales ever, and cheapest CDs ever (many supermarkets now sell for 8.99 etc) of course this is all because of the popularity of cd-wow and friends. But If they get shut down, the prices will be back up to £15 before the judge gets his wig off :(

What`s the BPIs problem?
Surely a sale is a sale & it`s better for the company as a whole (lets face it, they`re all worldwide) to get something rather than nothing.
This will just p**s joe public off even more & encourage more "illegal" downloading...
When will they learn? :/ ...The Brits are just sick & tired of getting ripped off ALL the time..(Toll bridges,when we pay car tax.......Don`t even get me started on that one >:( )

Its just another example of record label greed!!! If they win the legal fight and price people out the CD market what will they end up doing?
