What are my / his rights in this situation? HELP PLEASE - Update

Jim Morrison (Elite) posted this on Monday, 19th April 2004, 10:20

In January 2003 I sold a video sender that I got for Xmas on eBay because I didn`t want it. Everyhing went through fine - no problem. Today, 15 months later the guy rings me up and tells me that it now no longer functions and wants it mending.

Do I have to mend it? What are his rights / my rights?

Update: See page 3

I suspect you probably aren`t obliged to do anything and the buyer`s trying his luck...

Was there a manufacturer`s guarantee with the item? Is it still valid? Was it transferable (unlikely)?

I still have the receipt. I could send him that and say try your luck with the shop.

Tell him to stick it up his arse and tell eBay. I hate people like that, you get some real arseholes on eBay (and in real life!). My uncle sold my neighbour a lawnmower, which he used for a few months - it got a flat tyre and then he asked for his money back. My uncle obliged, fixed it, and then got a call from the neighbour asking if he`d sell it back to him again!

Why should the buyer not have the same rights as if he bought it from a retailer?

Jim.

My advice would be to politely tell the guy that after all this time it is no
longer your problem, he is the owner and it is up to him to get it sorted.

It sounds like he is trying it on,
dont worry about it.

Ignore the arsehole. He has no rights. It was a private deal between you and the buyer. When you sold it to him it did the job it was supposed to do, so not your problem anymore.

Tell him it`s the same as a supermarket. You got 28 days for a refund on electrical goods or else take it up with manufacturer. He is pushing it though.

Sold as seen.

Manufacturers Guarantee would even have expired by now so you owe him nothing.
