Anyone else subject to a `fair user policy`? (tiscali based thread)
I`m ok at the moment, but about a month ago I got an e-mail from my ISP (Tiscali) claiming I was in violation of their Fair User Policy. Basically they said I was using too much bandwidth as a single user during peak times. (6-11pm monday to sunday (why they don`t just say all week is beyond me))
When I signed up with tiscali part of the reason I did so was their promise of no Bandwidth caps. To me I took this as meaning I could use the full capacity of my internet connection 24/7/52.
But in the e-mail they claimed if I didn`t calm down my bandwidth usage, then they could limit my internet connection. Can they do this?
The only reason I joined Tiscali was because they were damn cheap and promised no limits on my internet usage (which my previous ISP was introducing - BT) If they cap my bandwidth can I claim false advertising?

I`ve had exactly the same.

I`d love to know if we could claim this.

Just sent them this

I fully understand why you have the FUP in place, but why are you restricting my downloading outside of the FUP hours.
I have a friend in IT and after several hours of investigating my system and connection it appears you are packet shaping my traffic inside and outside of the FUP.
I feel this is breaking your side of the contract which i entered as this was not mentioned in your terms and conditions, the package was described as "unlimited" subject to FUP but nowhere in the FUP print was there any description of CONTROLLED traffic outside these hours.
I look forward to your reply.

There`s great concern in the industry at the moment over the use of the word "unlimited" when it is completely untrue. A number of people have lobbied both OFCOM and the ASA (advertising Standards Agency) however neither have decided that ISP`s are in breach of any code or regulation. Go figure!
If you look at the ADSLguide forums you will see almost every ISP now limits the amount of traffic through either a hard cap, a "hidden" FUP cap, or traffic management/throttling.
The ISP I joined 6 weeks ago advertised as "no restrictions" and have now just implemented traffic management. The days of truly unlimited connections are sadly over... :(

im coming to the end of my 12 months with tiscali - who do u guys reckon i should go to now- for reliablility and possibly uncappedness. i think my line supports 2mb atm,
but a check via adslguide/bt suggests i can go up to 6/8mb

Check the Blueyonder site, if you`re in a cable area (also see NTL, I think they`re uncapped now and are essentially the same company), go for it. 100% cap free and no intentions of introducing them.
I can`t recommend them enough.
