Big up to mortisian,

ordered bed never expecting to receive it. Phone received same evening explaining it was a mistake and it would not be dispatched and my credit card would be credited.

Received a letter from M&S this morning again explain it was an error and due to their terms and conditions the order had been cancelled ------- ALSO ----- "please find enclosed a £20.00 gift voucher as a gesture of goodwill"

What a result - total cost ot me - £0

Total profit £20 , thanks mortisan, I am off to Marks to spend my £20

I thought if they took payment that is entering into a contract which you could have enforced legally!

A lawyer or barrister are you? There is no need for your tone, these are friendly forums and they are here for advice not abuse of fellow posters!

A seller does not have to honour price if they haven`t taken money and they have E&OE somewhere in their t&c`s.

However, by taking payment they have concluded the contract of sale and you can (IFYOU WISH) enforce that against them!

You do not have the right to go and ask for the item at the advertised price unless they offer the same, but, if they take payment then you are entitled to goods or seek redress for the same!

CHILL OUT and cut out the abuse!

Glad you got something out of it. Like Random Username I never actually bothered myself once I saw their T&C`s as I knew that I wouldn`t be getting a bed in a hurry. Still just goes to show what persistance can do. Nicely done :)

i allways thought that once the company has took the money the contract is binding ? isn`t the exchange of cash the proverbial "hand shake" ?
