This really is about my flat mate and not me!
He has worked for the same company for 16 years. The past few years his life has been hell there. Overworked, overtired and overlooked.
Last week he went on holidays and plans never to return, not letting his employers know this as he is totally disenchanted with them. He wants no contact whatsoever again.
When he began he worked the usual month, then got paid. He is required to give a month`s notice.
Legally, can they do anything to him for (a) walking out without telling them and (b) not giving a month`s notice?

They can withold his last months salary as he did not give a months notice, less any outstanding holiday entitlement. If he has taken more holiday than he has `earned`, then they could also attempt to get extra money back off him through the courts.
Don`t think there is any specific issue with him not handing in his notice, although i am no expert, and they may be able to sue him as they could argue by not allowing them to identify a timely replacement he has had an adverse impact upon the business.

tbh, if i where him i`d give my notice in, but i`d also tell them exactly how big a shower of s*** he thinks they are then they might simply tell him they don`t want him to work his notice & escort him of the premises, this sounds a bit harsh, but if he does it that way they are still legaly bound to pay him his month in hand & any holiday entitlement he may be owed, & he`ll have the satisfaction of sticking it to them (tho not literaly :) cos if he does anything thats considered gross misconduct they can simply sack him on the spot)

I`d say he`d be better off giving them the notice. If he just leaves without notice, then not only could it hurt him financially (as stated above) but it could also harm his future job prospects, as if the current employer is asked for a reference, they could quite easily say he`s non-commital and unreliable.

You`re not allowed to give a negative reference, they would simply just refuse to give a reference.

Thanks for advice so far. I am copying it and will give it to him, for him to decide, when he comes back from hols.
He doesn`t want a reference from them. He is understandably pretty angry and bitter with them and would find it intolerable to work a month. They would also make him train someone for the job which he is reluctant to do.
I will add he is a very, very, very conscientious and hard working person. It is now at the stage though of the camel breaking the back (whatever the phrase is, I always getting them befuddled). Their treatment of him has made him quite ill.

Annie had a awful problem, similar to this before Luke was born. 2 members of staff at her previous placement were being evil bitches to her, back-stabbing, making false claims about her mistreating the clients (she works with handicapped adults). A client holoday was coming up, and she was expected to go away for a week with these 2 other women. the day before she had to leave she went to her doctor to ask to be signed off. The doctor said that she didn`t look very stressed out, annie simply replied that that was because she wasn`t at work.
If the situation is this bad, however, he could always go for constructive dismissal, where they`ve made the wrok situation so intolerable he`s had no choice but to quit for fear of his own health.

Oh, Bats, he should deffo hand in his notice rather than just walking. Can you claim dole if you walk?
