Page 1 of Speeding Ticket - advice please. Bowfer ot MS999?

I started a month ago as an Operations Manager for a bookmaker in London, managing the office is part of my responsibility. Today I got a NOIP from the police for one of my colleagues doing 50 in a 40, problem is that we dont know who was driving the car. It is a company car (leased by the company for anyone to use) and nobody is owning up. Obviously now there will be a register of who used the car, but what is the points situation to be?

As the manager, do I have to take this on the chin, and what happens, ie fine etc, if we are unable to name the driver?

Any advice welcomed please.

I should imagine whoever signed the lease agreement is responsible if nobody takes the blame.

I dont know if this will apply to you, but my mate who works as a car salesman reckons they get speeding tickets all the time, but when they come through, the manager say `we have no record of who was driving this vehicle` and since the cars are all registered to the company and you cant take points off of bricks and mortar then thats that.

He reckons when the new model C4 with the new engine came out, they racked up a stupid amount of points between them.

Naturally, this is all coming from my mate, but when I have driven with him in one of the sale cars (they use them as their own) he has driven like he had never heard of the word `Speed Camera`.

Well, the person who signed the lease agreement no longer works for the company, so thats a non starter. I have a awful feeling that I am going to be lumbered with this. It also sounds very unprofessional to go back to my bosses and explain that I dont know who was driving the car because no records have ever been kept and they run the risk of a large fine.

It is the responsibility of the last known registered keeper of the vehicle to provide details of who was driving at the time of the alleged offence. Failure to do so could result in a fine.

If you do not know who was driving then you should contact the Central Ticket Office of the force concerned who will advise you what action to take as policy may vary from force to force. Photographic evidence (if available) may resolve the issue.

If it is a company vehicle and no driver can be identified the it may be the company secretary/director is prosecuted for failure to furnish driver details. If every effort was made to identify the driver it is possible that the company will receive a warning letter and requesting that they implement a logging out system for vehicles. If they re-offend it is very likely that they will be prosecuted.

hmm, what a choice huh? Risk the wrath of my new bosses, or get 3 penalty points in my first year. Great, another 3 and I get a ban.....does anyone know how long the ban is?

Not sure if this Helps , But some Time Ago a Friend of Mine Received a Speeding Ticket

Him and His Mate were in the Car that Night and they Had Both Been Driving the Car During the Evening...and were Both Arguing who was Driving at the Time of the Speeding Ticket as Neither wanted to Pay the Fine and Cop the Points

They asked if the Matter can be verified and they were supplied with a Photo of the Driver as Proof ...I saw the Photo and it was Clear Who was Driving

Not sure who they Contacted ...It was Either South Wales Police or the Safety Camera Partnership or Whatever it is Called ....obviously the Offence Happened In South Wales

Not sure what the Situation is in your Area ...But if you do not ask you do not get.

Although if you can get a good Photo I would love to be a Fly on the Wall when you flash it to the Offender and ask them to Explain it.

Hearsay and rumour relate a tale that in a situation such as this, they can`t give the points to anyone, as points have to be dished to the offender, and not the owner, with only the fine being the only penalty given.

However, many moons ago, I was caught driving my dad`s car while uninsured (We thought I was covered). I got done for driving while uninsured, my dad got done for allowing an uninsured driver to drive his car. £385 and 6 points EACH. (If he`d said he didn`t know I was driving it I would have lost my license - love ya dad) Wether or not the same allocation of punishment follows with this case I dunno...

Incidentally, if the driver is discovered, i`ll assume a disciplinary kick up the arse will be the order of the day..

You could ask Detective Superintendent Adrian Roberts of Cleveland Constabulary (try Google) to advise.
