have i got a misselling case for compensation

marto1 (Harmless) posted this on Sunday, 4th November 2007, 18:58

went and bought a secondhand car from a renault franchise .liked the car asked sales man who owned it he said it had been registered to renault and most probably used by one of their managers they do this to keep thier sales figures up so i bought the car for 12k when i recieved the log book a couple of weeks later it said that eurocar had been the registered oweners .when i rang up to query this they told me yes but europecar is a subsiduary of renault so its ok .i told them im not happy because 1 i might have not bought the car if the proper info was given to me and 2 if i had bought it i would not have paid that price for it .have i got a case and whats the best way forward .my wife was with me at the time so its not his word against mine i got a witness

What is it you`ve bought marto1 and what mileage?

Is it a popular rental car type or is it perhaps a genuine ex- management car from their staff fleet.

Check what if anything has been done to it, new tyres fitted? same brand and type as spare(assuming not spacesaver). Any hint of bodywork having been spruced up from ex rental prangs. That sort of stuff should help answer any queries. I`m sure bowfer will post to this tomorrow and add his knowledge.

However it is a bummer when you buy something and then don`t have that lovely glow of contentment of having got what you were expecting.

To be fair if i was spending 12k i would of Hpi`d it beforehand myself(best £40 you could of spent) i`m afraid you are stuffed mate buyer beware they have not mis-represented anything have they?? (your wife might be seen as a interested party so not so independent) and if the car looks and drives ok what is wrong?? your just concerned about ex hire car image/abuse etc but at least you should have a warrenty etc better than buying a clocked car from a private seller (or worse a dealer petending to be private) sorry but it`s like people having a cheap house survey then moaning about repairs etc

Why compensation??? have you spoke to the dealer about your concerns?? or are you just hoping to make a quick buck by using the "C" word

sorry i just hate this "i want compensation culture" :/

it is a renault megane 1.5 dci 106 hp diamonique 14000 on the clock .its not about compensation its about paying a fair price for the product offered to you . if the car was used by a vicar or someone just driving local they would have made a point of telling me this .people generally rent cars for long journeys ,it might have had 20-30 different drivers might not have mind you but that would have been my choice to decide .my resale value could well be affected ,because there is a stigma about it being a rental car .and finally the salesman thinks its ok to tell me its registered to renault when its actually reg to europcar .if 10 people went to by a car and was told it was renault reg they might buy it but how many people would have bought it on being told it was reg to europcar not many i dont think unless there was a lower price to tempt them .bottom line is the salesman lied

14000 on the clock

Well i;d suggest that unless the clock has been fiddled with at 14,000 miles its not likely to have been a rental vehicle!

It may not be the case that he thinks that.

What if for instance the person who has provided him with that detail has just provided a hideously poor assessment of the cars history?
If Renault do indeed own Europcar then the provider of the info could have easily poorly phrased his statement to put an incorrect spin in the information and hence what you have been told is an honest mistake - a kind of chinese whispers scenario if you like

I;d agree with you if the statement finished with "registered to Europcar as a rental vehicle".
It is not beyond possiblility that the car was provided to be used as a "staff pool car" only to be used when staff had to drive to attend meetings etc (hence only 14k mileage) and hence i;d suggest whom it was registered to is irrelevant - what you need to establish for sure is how the vehicle has been used not who owned it`s registration

At present I dont think you have enough proof of that for definate - i understand your feelings but objectively I dont think thats a bona fide claim yet

Personally I dont see how you can have any re-course unless the clock has been fiddled with and the 14,000 is a false number. I dont think it would do any harm for you to go back to the dealer and raise the question regarding the registration details of the car and what you were told - if only so that you can pass on that information to any future purchaser.

personally i dont think there is any element of deception - that would lead you to a successful compensation claim, however i would raise it as a point of contention with RenaultUK, for some free servicing or similar.

As a point of interest to you, i purchased a brand new DCi renault approx five years ago direct from Renault... when it came to the first MOT i booked it in a 1 week before the 3 Year Warranty was up... imagine my surprise when they told me the `Diesel Injectors` needed replacing and that would cost about £800... and then their Service Managers surprise when i said thats ok, go ahead and do the work, as its still under Warranty till next week! His face just absolutely sank...

My best mate is aparts and service manager for an extremely `large` dealership that sell some prestige motors... and he says in some garages it is common practice for these sorts of incidents to occur! No all my servicng/MOTs etc are done by the local independants!

They`re all bent as f***.
A friend had the local dealer call him to say all 4 tyres on his car needed replaced.
"fine" he said "I`ve got it on a service contract that includes tyres"
Lo and behold, no new tyres when he went to pick it up.
One of the girls here was nearly stung for a new gearbox too, co she reported noise when reversing.
I saved her £800, by showing her it was one of the mudflaps rubbing against the tyre whilst reversing on full lock.

I`ll give you a laugh at Renault`s expense though.
When I bought the wife`s new Clio, it came with 3 years free servicing.
I told them I wanted money off instead, so the sales guy made a note on their system saying "money off, no free servicing"
Two weeks later, the free servicing pack turned up in the post and I`ve had two free services (worth £360) off them. 8)

With regard to this case, I would think you`ve every chance of getting your money back off Renault.
They cannot get away with not advising the car was originally a hire car, simply by saying Europcar is a subsidiary of Renault.

"you said my car was registered to Renault"
"yes sir,stunt-cars-r-us are a subsidiary of Renault"

My boss was told by the garage that he needed new tires. Job was supposed to have been done. 4 weeks later, car at a different garage, and they say the same thing.

2 new sets of tires in 4 weeks? I don`t think he ever did work out which garage was stiffing him.

What plate is it?
At the moment I am looking at Megane Dynamique 1.6 16v Petrol.
I have spoken to two local dealers one wants £7.5k for a 54 plate and other wants £8k for a 06 plate...both mileage under 12,000
£12k seems like a lot of cash to me for similar...

TBH, tyres aren`t something one should be letting oneself get stiffed for.
They are the most visible consumable on a motor.
How on earth drivers get to a stage where they don`t know the state/depth of their tyres is beyond me.
If a garage tried to stiff me for tyres, I`d be able to answer "they`re f***ing fine" in a shot.
Brake pads, for example, are a `trust` item with a garage.
If they say they`re f***ed, you kinda have to believe them (going by mileage etc.)
