Sorry to be a pest guys but my boy has just come in very upset. He was driving along( in a convertible) and his phone went off with a text. He lifts phone looks who has texted and puts phone back down. Unmarked Volvo then pulls him up and issues him a fixed penalty notice of 3 points and £60 for "Use mobile phone whilst driving". This is where the advice bit is needed....

My son has handed over his drivers photo licence to them and they have put driver number, address, date of birth etc on pink "notice of conditional offer of fixed penalty" he came home with. The thing is they have got his D.O.B. as 1988 instead of 1985 and three digits wrong in his driver number. What should we do? Your advice would be much appreciated.

I can only agree with you on that one, we told the kids umpteen times not to do this, but sadly doesn`t help the predicament.

Presumeably he didnt have all his documents with him so he has been given 7 days to produce them at a local police station (of his choice), if this is the case when he takes them in they will take his driving Licence both parts from him and send this to DVLA for the ENDORSEMENT (3 Points) also take a covering letter pointing out the inaccuracies in the completion of the form by the attending officer, that they will forward this also to DVLA, also i would send a letter to the `Central Ticket Office`, with the payment explaining that the form is incorrect.

If the innacuracies are as you state, i would suggest that it will be VOIDED!

It may be worth contacting the local police station and asking for a number for the Central Ticket Office, so that he/you can speak to someone!

You may be lucky that because the form has been completed incorrectly then it MAY BE VOID... if this is the case the Officer may still return and issue your sone with Notice Of Intended Presecution, and he could be summonsed for the offence, although that would be harsh, and i would argue the case at court that the officer should have completed it correctly the first time!

It begs the question though if it had been a marked car behind him would he have `answered` his phone... it is amazing what arrogance you see in drivers, when you are driving an unmarked car, as opposed to a `Panda`. ;)

Either way i hope he learns form this mistake... if he has had his license less than two years another indiscretion, and he will be catching the bus again!

Ticket = £60 + 3 Points... a Hands Free Kit less that £50, you choose?

Mark, he didn`t get a producer for docs. Up here in Scotland the procedure is just like a parking ticket, you take/send pink slip, wonga and driving licence to the clerk of the district court and they "write it up".

edit:He didn`t answer the text just looked who was on screen. We bought both kids bluetooth headsets when they came out. We told them not to touch the phones especially after he got his sports car as would be a "choice target" in it.

As to learning from his mistake, let me recount what happened to me years back when I was still working.
Driving through the Highlands at intergalactic speed, I slowed down when entering a small village(20 houses or so) to what seemed like snails pace. An officer of the law came out from behind a wall and signalled me to stop. I lowered my window and he asked if I knew the speed limit? I replied 30mph officer. He then turned the speed gun round and showed me I had been doing 56mph. I thought my licence was going to be visiting the shredder! Instead the police man proceeded to "tear me a new @rse" and said if he ever caught me doing this again it would result in prosecution. This telling off had a much more effective impact on me as since after this I always went by the 30mph limit. After becoming disabled I drive slower than most grannies :( and stick to all limits religiously as being stuck in the house with no wheels would be a real bummer.

didnt realise you were north of teh border... in which case ignore what i say we deal in the law in England and Wales... i would still suggest however that the form being inaccurate may lead to it being VOID... good luck anyway!

i;ve heard, and seen in various places, on numerous occasions that for speeding tickets and parking tickets that if they are filled in correctly (or if they have been produced with incorrect wording in the print) that the ticket is void and the penalty unenforcable.
There was a big thing about it last yr sometime where large batches of tickets were being voided due to one word being missed out of the printed form (or something similar) and that councils / police forces were now being careful to ensure this did not happen

I can only assume that the same would be the case for a ticket for this sort of incident


I;d definately pursue the possibility of this ticket being declared void due to incorrect completion (a k a incompetence)

And even if your lad gets away with it a stern talking to and a strong pointing out that few of our fine boys in blue are going to make such a mistake to get him off the hook for being so foolish in the first place may be in order

Thanks Mark. Gonna try the Citizen`s Advice Bureau tomorrow for legal advice as they have a legal team ( who work short days 10 till 4 ;) )

Of course I guess you could take the hard line on the lad and just make him pay the fine and take the points

(possibly hoping that someone in the system will maybe notice the errors and void your notice without you appealing it)
