Boxing day can my employer force me to work ?

dkuk2000 (Elite) posted this on Wednesday, 16th September 2009, 17:31

It`s that time again >:(
I work in a large department store and the Christmas opening hours memo has just done the rounds full of the usual crap apart from the following:

Quote:
As December 26Th falls on a Saturday this year,The bank Holiday has been moved and will be on Monday 28Th December, Therefore staff who normally work on a Saturday will be required to work on this day.

Quote:
Rota leave days are suspended for w/c 21st and 28th and should be taken from 11th January

Can this be enforced ?.

Forgot to mention my contract states that Bank holiday working is voluntary and we only get 20 days paid holiday a year.

Any advice ?.

It`s NOT a Bank Holiday. I don`t think you can do a lot except skive if you want to risk a sicky, or book a legitimiate day`s annual leave.

The Saturday and Monday are Bank Holidays according to my diary.

With the current employment climate being what it is, employers will try to pull crap like this. The question you have to ask yourself is, given the current employment climate, can you afford not to let them get away with it?

Public and bank holidays
You do not have a statutory right to paid leave on bank and public holidays. If your employer gives paid leave on a bank or public holiday, this can count towards your minimum holiday entitlement

and

Quote:
When the usual date of a bank or public holiday falls on a Saturday or Sunday, a `substitute day` is given, normally the following Monday. For example in 2009, Boxing Day is actually on Saturday, 26 December, so there is a substitute bank holiday on Monday, 28 December.

I though that if Christmas/new years fell on a weekend you get an extra day to compensate, ie if Christmas day is Friday and boxing day in Saturday, you get Monday off as a hol as you `missed` your bank hol as it was a Saturday, so I would assume Saturday isnt a hol and the `official` Christmas hols would be Friday and Monday meaning employers have the right to open and expect workers to work....

Im in a similar situation as I only get 21 days paid holls and Im expected to keep days from that to cover the Christmas shutdown. I have no choice in this, so in reality I get 17 days paid leave...then we have a summer shutdown for 2 weeks (that nobody wants but the boss claims is good for the company) so I lose 10 days for that so I get 7 days to take when I want, 7 bloody days ...I hate my job

I also thought you only get the `official` bank holiday so you should get the Monday but work the Saturday.

Not going to mention how much annual leave I get!! Only good thing about my job

As an ex retail Manager working the Saturday would seem to be pretty standard retail tactics as the shops would be open, so in answer to the question yes if you normally work a Saturday you would be expected to work. Retail is probably the worst area to work in during the Christmas period as most only shut for Christmas Day/Boxing Day and New Years Day. I used to get 30 days holiday and days in hand for the 5 Bank Holidays so could have been as much as 35!!

I only get 30 days now but 6 weeks is pretty dam good.

As far as I can see from diaries and peoples comments the Saturday is not a bank holiday so therefore if your contracted hours fall on a saturday you will work.

The bank holiday reverts to the monday and so, under your contract, I imagine they can only get you to work that day if "you volunteer"

Sorry dude but i reckon you`re working on the 26th!!
