Driving licence question ...probably one for marksparks999 to answer...

Ok, a Turkish lad at work (Id say workmate but I dont like him lol) has failed his driving test 2 or 3 times over the last year or so (the last time getting a warning as he verbally abused the tester when he was told he had failed resulting in him being told he will have to have an second tester in the car with him on his next test :¦ )

This week he turned up in a car, and when we asked him how he was driving when he didnt have a licence he claims his Turkish driving licence covers him to drive in this country for 12 months, I doubted this and looked on the DVLA site to clarify and the only info I could find was that a non EU driving licence is valid in the UK for a period of up to 12 months once you set up residency in the UK, when the 12 months is up you have to a) pass the uk driving and written theory test or b) stop driving. He is resident in this country and has been for several years (he has an English wife and kids, a house, full time employment etc) surely his 12 months of driving would have elapsed after he had been resident here for 12 months (regardless of if he drove in those 12 months)

He claims that if he visits Turkey once a year this somehow renews the 12 months so on returning from his holiday he can drive for another 12 months in the uk with his Turkish licence, surely this is incorrect?

Ive told him as far as I know his licence is invalid and so he will not only be driving illegally but as far as I understand without insurance too as not having a valid driving licence will void his insurance and if hes caught he could very well be banned from driving, face a fine, points on his yet to own licence and hopefully see his £3000 car turned into a 3 foot square paperweight

Can anyone in the know clarify the law?

I`m not an expert, But I`m pretty sure popping home for a short period entitles you to another 12 months of bugger all. The guy is driving illegally, and without a valid license, he`s also driving without insurance. he nees to be taken off the road as soon as possible.

Assuming that the "residency/domiciled" label doesnt differ for tax puposes and driving purposes then returning to Turkey for a short holiday will not act to remove his residency in this country (he still lives here for more than half the year blah blah blah) and thus I see no way in which his "12 months" of grace on using his Turkish Licence can be renewed

Ring the cops, it`s ignorant tossers like that who mean we all end up payuing more in insurance premiums etc
(I;d also assume that having failed his test on more than one occasion there is a reason for it and given his mindset in blatently abusing the law I wouldnt be surprised if he doesnt give a stuff about anyone else on the road and is likely to cost people in many other ways too)

Definitely not allowed to drive. Spent a few years renting out cars and we used to get people trying on all sorts of tricks to convince us they had a licence.

Simple facts are the 12 months are a one off for when you first move abroad. Heading home for a weekend doesn`t grant you another 12 months.
