Legal question?

mathew2001 (Competent) posted this on Saturday, 18th May 2002, 13:32

I have a playstation, which has been chipped and has a vcd card. I have about 20 copy games with it, and about 10 VCDs. I want to get rid of the lot ( with original games, controllers, mem cards etc), but I am slightly concerned about the legal aspect of reselling the CDrs and VCDs.
I`ve seen people blatently selling pirate VCDs and games etc on Ebay for years now, but that does not make it legal now does it?
I dont really want to sell it without them, as then I would have no use for them!

Any suggestions that anyone could give me would be great!

Cheers!

Mathew

Sell the playstation, perhaps at a little higher price, & give the games away with it.

So do you mean that I should phrase it something like this:

Sony playstation bundle, etc etc...............

if you win this auction, I will include for free, blah blah etc etc.......

Giving the games and films away doesn`t alter the fact that they are illegal.

Selling the PS at a higher price and then "giving" the games away would not make the transaction acceptable in the eyes of the law.

Though I`m not condoning video game piracy if you did want to sell the Playstation and games why not write

"Playstation with 20 games and VCDs - worth over £50"

Then you are NOT lying. The Playstation is worth £50 and you are not advertising the copies as being worth anything. Still boils down to giving them away and is still illigal, but its a way of maybe getting past the mods on ebay. Saying that they are very strict. My friend tried to sell his chipped Playstation 2. He dind`t include any copied games with it, but because it was advertised as containing a Neo 2.2 modchip it got removed.

Thanks guys, I think I`ll avoid Ebay, and try elsewhere!

Surely Ebay are going a bit over the top mind if they wont let you even sell a modified console. Surely its not illegal to chip the unit, or is it? I though that once you had bought a piece of hardware, you could do what you like with it?

It isn`t illigal to chip your console although Sony did file a law suite to prevent Messiah and Neo from producing any more modchips. People now have to use clones of the chip (e.g. Elvis is a Messiah clone) or will have to be lucky and get a genuine Messiah - like I did.

mathew2001, I dunno anything about law and stuff so I cannot help you a lot. I just wanted to make a comment about Ebay. They don`t seem to be as strict as they want to be seen. While reading on a german forum I found a threat about a bloke(everyone was complaining about him) who sold pirate DVDs and VDCs (actually they were VCDs but he advertised them as DVDs) and he`s been doing it for quite some time without ebay giving a sh*t about it. Mind you this is valid for the german branch of ebay, maybe the UK branch is more competent/strict, which wouldn`t be the best cas scenario for you if you try to sell your VDs and ripped games.
Oh, did you actually pay for the games or just ripp`em from am mate, If you didn`t pay then you might throw them away that certainly won`t get you in any trouble.
HTH(probably not, nevermind)
