Do you think I trust these people anymore?
It is the principle.
I work in the building systems installation industry, if we quote something and a client accepts our offer we issue an order acknowlegement. This is a binding contract!
We cannot then turn around and say sorry we have run out of stock.
We have to buy it in and then supply it even if it is at a loss!
Why does this not apply to the Internet!
My MP will be hearing about this.

Hi,.....

I agree with U as well.

I just sent an e-mail to them asking about the X file box set.

They sent a mail to me saying that they have run out of stock. At the same time, they r still selling the boxset for 90 pounds.

Tell this to your local MP.

I`ve also sent an email highlighting my disappointmnet and asking why its still available @£90 +. If more of us kicked off at them would they have a change of heart?

Another question, when does a contract become binding on internet purchases?

Herein lies the problem.

Do you know? Does HMV know? Does your MP care? Does your lawyer want you to pay him to find out over a £30 DVD? Bet your arse he does.

I would have thought it was the moment you had an electronic sales receipt, not just a placed order. If the latter were the case, if you cancelled that order HMV could force you to pay for it...

I have to admit HMV are useless, their site has never let me register, so i therefore spends hundreds of pounds a yr elsewhere. Their loss.

They do not care about the one or twenty thousand who have a problem,
They have a flagship store in London visited by thousands everyday.
They have shops all over the country and they have a crap internet stock control/order processing system.
DUR, we have TEN!!!!! X Files box sets to sell. Where was this stated on the sale site!
DUR, we have confirmed to 300 people that we are sending theirs out!
DUR, oh dear we may lose £50-00 per unit!
I know lets tell everyone that we haven`t got any! (we have sold them all to our own staff!).

Our staff are selling them for a profit on ebay!
good for them!
lets screw our loyal customers, we don`t care, we have mugs visiting us all the time.

I think I will refrain from clogging up the Forum for a while. To say I am fed up with HMV is an understatement.

I went to my nearest HMV last night. As expected - no X-Files but I picked up Reservoir Dogs for £12.99 (not bad). The point of this reply is actually to question their `free gift`. Whilst I was paying, the checkout boy said that as I had bought some sale goods I get a free 24 cd wallet. I didn`t actually need one, but the point is, had I wanted one & been standing next to someone in the queue who had been given the free gift when I only had full price goods (& so not eligible) I would`ve been quite narked! Just a thought...

What`s this about a free gift??

I spent £40 in the HMV in Leadenhall Market yesterday, and al I got was a free plastic bag (and that had a hole in it)!!

yep - they gave me a free CD holder as well....and the plastic bag. I shall never complain about anything, ever again.

Hello all!!

Just to let you know I am currently studying the law of contract and I think we may have something here.

In order for a contract to be made there must be Offer and Acceptance. In this case if you offered for the DVD set and they accepted the offer by confirming that the order was made. If they sent you an e-mail which said they couldn`t complete the order BEFORE they said that the order was accpeted then they are not in breach of any contract.

HOWEVER

if they processed the order and led you to belive that the item was in stock (eg the web site said it was) then turned round after and said the item isn`t avalible they may be in breach of contract.

UNLESS

did you read the small print? Take a look, it`s likely that it says something about `out of stock` items which clauses out this. It`s always worth skim reading the small print.

Anyway the best thing to do is contact their head office and boycott them. Tell your friends not to shop there, it`ll hit them where it hurts most......their profits!!!!!

Don`t know if anything here makes sense. Probbly not. Oh well :p
