I think where he went wrong was openly advertising selling chipped ones with pirated games on the harddrive!
there`s loads of sites offering chips or consoles with chips.
if he had just offered the games as an "extra" like a massage parlour ;), he probably would have got away with it!

That doesn`t matter. It`s not just illegal to sell modded consoles, it`s illegal to mod consoles.
But then, if you`re going to get people modding their machines specifically so they can run pirated games, whaddaya expect? Buggers just ruin it for everyone else, the... buggers!

Absolute bollocks.
What you do in the privacy of your own home with equipment you bought is your own business. It is not illegal.
Plus selling chipped consoles is still a bit of a grey area, and you have to remember that the mentioned article would have been put out by an interested party, and not checked properly by a lazy journalist.

Under the European Union Copyright Directive, the EU`s blatant "follow the US wherever it goes" knock-off of their Digital Millennium Copyright Act, it is illegal to interfere with or bypass copy protection systems.
The UK implemented this directive in 2003.
Now, how you interpret that is up to the individual, i guess.There`s almost certainly nothing written about chipping of modification, but the Justice in the case obviously interpreted "modding consoles" being in direct violation of the directive, ie, illegal in his eyes.
If anything, it the consequences, not the act of modding that they`ll come down on. But not in this case, as the guy was a complete dolt for selling pre-loaded games.
That`s why the chap will putting 100+ man hours into cleaning graffiti from under bridges.
But it is very choppy waters.

I`m just saying that there`s a pyramid of `dodgyness` that anyone prosecuting will use.Top will be the ones sneaking early versions of the games out of the software houses........about 3 steps below that someone selling modded consoles....another four steps below someone modding a machine for themselves etc.
